State Nullification of Federal Law

Angry rhetoric from the right and naive compassion from the left? (Keep it civil please)

State Nullification of Federal Law

Postby Jeroth » Thu Aug 29, 2013 9:55 am

In recent years there has been a trend of states to legalize or decriminalize certain laws despite Federal Laws in place regulating such items. Was wondering where everyone stood on this in relationship to this:

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Examples- Marijuana on the left coast. Guns in the central states and powers of federal agents to enforce certain laws.

The counterpoints to the 10th amendment are the Supremacy Clause: Article. VI.
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

and the Commerce Clause

Article I, Section. 8:
The Congress shall have Power...To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.

And to a lesser extent the Necessary and Proper Clause:

Article I, Section. 8:
The Congress shall have Power...To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.

Where is the division of state and nation anymore? If the 10th amendment is meaningless, then what is the point of having individual states? Lump it all together and do everything by popular vote and be done with it.

Just more mad musings. Feel free to jump aboard or abandon ship as may be.
